Minister of Investment and Downstream Industries/Head of BKPM Rosan Perkasa Roeslani revealed that the positive fictitious licensing process has been implemented as of October 5, 2025.
This positive fictitious mechanism means that if a license application is not followed up within a certain period by the relevant ministry or institution, it is considered legally approved and will be directly issued by the Ministry of Investment and Downstream Industries or BKPM.
“Since October 5, 2025, we have implemented the positive fictitious policy, where licenses involving other ministries or agencies can be issued by our ministry according to the agreed Service Level Agreement (SLA),” said Rosan during a press conference at his office in Jakarta, Friday (10/17/2025).
“So there will be no more delays regarding what has been promised to investors,” Rosan emphasized.
This positive fictitious business licensing mechanism is based on existing legal foundations, namely Law No. 6 of 2023 Article 175 Paragraph (7) and Government Regulation No. 28 of 2025 on the Implementation of Risk-Based Business Licensing.
Based on these legal foundations, Rosan stated that the Ministry of Investment and Downstream Industries/BKPM has issued 132 business permits using the positive fictitious system through the One Single Submission (OSS) system.
“The consequence of the integration we have implemented has a positive impact, but we must also enhance our competitiveness—not only in natural resources but also in technology. We continuously improve our tools, and in the future, we will be better at providing accurate and fast services in compliance with existing regulations,” Rosan explained.
